Advertising on Dragon Boat Net - Terms and Conditions
General: Dragon Boat Net, in the following referred to as DBN, is a product of CDW is a Hong Kong based sole proprietor company, owned by Henning Wiekhorst and undergoes with the laws and regulations of Hong Kong S.A.R. Booking an advertisement, referred to as Ad in the following, on DBN results in entering a contract with CDW. When finalizing your booking and/or purchase of an Ad by ordering and paying it you automatically confirm your knowledge of this Terms and Conditions, which are designed to clarify the deliverables by CDW and to avoid possible misunderstandings. CDW is committed to provide its services on the best possible quality level. If these Terms and Conditions leave any question open to you please don’t hesitate contacting us for clarification before you place an order.
Payments: Payments are processed via the Online-Secure-Payment-Service Provider Pay Pal, which provides payment security for both, seller and buyer. An order is given to CDW with the successful payment via the relevant payment buttons on DBN or on any other web site run by CDW. CDW will process your order only after having received your payment upon which you will receive two e-mail notifications:
In the event of having purchased the wrong product, CDW will not refund you, but you can contact wiekhorsthenning@mac.com in order to get the service for another product of the same value.
Malicious Content: CDW does not support malicious contents and direct links to other websites with malicious content, which is specified as follows:
In the event of CDW receiving an order that promotes such malicious content as specified above, the order will not be processed and no refunds of payments will be granted.
Force Majeure: If CDW is not able to fulfill your order due to reasons being out of CDW’s control, like natural catastrophes, war or anything the like, no refunds will be granted. CDW’s web server stands with a web hosting service. In case this service is temporarily down but for a longer time, which is longer than a week, your order will be prolonged accordingly after the service has resumed. In the event the web server does not resume service, the clause mentioned above of Force Majeure comes effective.
Refunds: Refunds will be granted only in case of over booking on DBN’s advertising space, leading to CDW not being able to fulfill your order.
Prices: Due to competitive Ad prices for Standard Ads and Running Banner Ads the announced prices are valid for any page. No differences are made. For any Ad you order, except the Commercial-Links itself, you are granted automatically to be listed in the Commercial-Links of DBN for minimum one year, but most likely much longer. Please refer to the separate conditions for the Commercial-Links as shown on their ordering page. CDW follows a policy of certainty for its customers. If today you pay a certain price for an Ad running for one year and the next day CDW would change the price or discount, it would not affect your order in anyway. The price is valid for the entire term booked by you. The new price only will affect you when your order has timed out and you want to place a new order. Every order you place, is regarded as stand alone package, which means an accumulation of running time for better discounts on later orders is in general not possible, unless special agreements have been made within high volume advertising campaigns. By keeping the above, CDW reserves the right to change its prices and discount schemes at any time.
Order Processing: Once CDW has received your order, you will be contacted via e-mail. You also may express your design wishes, if any. CDW will do its best to satisfy those as far as possible and justifiable within your order. In the event that CDW fails to obtain from you the Ad content for whatever reason, an Ad with the following text will be posted as fulfillment of the order: “To contact (Your name), CLICK HERE”. Your are advised to contact CDW via wiekhorsthenning@mac.com if you haven’t heard from us within one week after having placed your order.
Processing Time: The time it takes us until your Ad is finally shown on DBN will depend on what kind of Ad you have ordered, on the complexity of your Ad and on how fast we can get the content from you. Commercial-Links can be on within only a few hours while a Video Commercial or Whole Page Ad can take a week or two. However, the running time of your Ad starts counting only from first day it actually is uploaded to DBN and can be seen the first time. CDW in each case will tend to get your Ad online as fast as possible.
File Formats of supplied Ad content: You will need to supply CDW with the content of your Ad. We prefer the following formats:
For other formats please pre-check with us. To enable us of linking your Ad with your own web site, we will need to know the URL, which is nothing else than your Internet address. If you don’t have a web site, you also can provide us with an e-mail address via which you want to be contacted when someone clicks on your ad.
Ad Placement and Positioning: As long there is a choice, you may specify the page on which you would like to see your Ad as well as the position on that page. On a “First Come, First Serve” basis CDW will put your Ad automatically on the best visited pages where it will fit according to the ordered size of the Ad. In case you are an existing customer who wants to maintain the expiring Ad placement and positioning, you should place your new order latest one week before the old one expires and state the word “RENEWAL” in the optional remarks field of the Pay Pal payment form.
Liability: CDW will not carry any liability for any kind of possible damage arising from the content of any Ad shown on DBN and/or from possibly delayed placing of an Ad on DBN. Solely responsible for the content of an Ad is the advertiser, which includes possible copyright issues. CDW assumes the one providing any content to CDW is also the one having the legal right to do so. CDW refuses any liability for any content of web sites, in its widest meaning, being linked to or from DBN. CDW offers with DBN an advertising media on the Internet, which is highly frequented as CDW is promoting it. - End - |
